01About us
maskrey.studio is operated by Maskrey Studio, a web design studio based in Derbyshire, England,
run by Joe Maskrey ("we", "us", "our"). You can reach us at
joe@maskrey.studio.
02Acceptance of these terms
By accessing or using this website, you confirm that you accept these Terms of Use and agree to
comply with them. We draw them to your attention through a link in the footer of every page; the
limits on our liability in section 8 are particularly important, so please read them carefully. We
recommend you print or save a copy for your records. If you are using the site on behalf of a
business, you confirm you have authority to bind that business to these terms.
03Permitted use and acceptable use
You may use this website for lawful purposes and to learn about and get in touch with us. You agree not to:
- use the site in any way that breaches any applicable law or regulation, or is fraudulent or harmful;
- attempt to gain unauthorised access to the site, the server on which it is stored, or any connected server, computer or database;
- introduce viruses, malware, or other material that is malicious or technologically harmful;
- attack the site via a denial-of-service attack or attempt to disrupt its operation;
- scrape, harvest, data-mine or systematically extract content or contact details from the site, or use automated systems to do so, without our written permission;
- reproduce, copy, resell or exploit any part of the site except as expressly permitted below or with our consent.
We may suspend or withdraw access to the site, or report you to the relevant authorities, if you breach these terms.
04Intellectual property
All content on this website — including the text, copy, design, layout, graphics, animations,
code, and the "Maskrey Studio" name and branding — is owned by us or our licensors and is protected
by copyright, trade mark and other intellectual property laws. All rights are reserved.
You may view the site and print or download extracts for your own personal, non-commercial reference.
You must not otherwise copy, modify, republish, distribute or use any content for commercial purposes
without our prior written permission.
Any examples of client work, portfolio pieces or brand names shown on the site remain the property of
their respective owners and are displayed for illustration only.
05Accuracy of content and no advice
The content on this website is provided for general information about our studio and services. While
we take care to keep it accurate and up to date, we make no representations or warranties, express or
implied, that it is accurate, complete or current. Please check anything important with us before
relying on it.
Nothing on this website constitutes professional, business, legal or financial advice, and it should
not be treated as a substitute for advice tailored to your circumstances. Descriptions of our
services, timelines and results are illustrative; specific commitments are only those set out in a
signed agreement for a particular project.
06Availability of the site
We provide the site free of charge and do not guarantee it will always be available or
uninterrupted. We may suspend, withdraw or restrict all or part of the site for business or
operational reasons, and we are not liable if it is unavailable at any time. You are responsible for
making the arrangements necessary to access the site, and for ensuring anyone accessing it through
your connection is aware of these terms.
07Links to and from other sites
Where our site links to other websites or resources provided by third parties (such as our booking
tool or social profiles), these links are provided for your convenience only. We have no control over
the contents of those sites and accept no responsibility for them or for any loss or damage that may
arise from your use of them. The existence of a link does not imply endorsement.
08Our liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so. This includes liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; and
- any other liability that cannot be excluded or limited under English law.
Any exclusion or limitation of liability for a statement or representation in these terms applies
only so far as it is reasonable under section 3 of the Misrepresentation Act 1967 and section 11 of
the Unfair Contract Terms Act 1977, and nothing here excludes our liability for fraudulent or
negligent misrepresentation to the extent it cannot lawfully be excluded.
If you are a consumer: we are responsible for loss or damage you suffer that is a
foreseeable result of our breaking these terms or of our failing to use reasonable care and skill,
but we are not responsible for loss or damage that is not foreseeable. This website is provided for
your private, non-commercial use. Nothing in these terms affects your statutory rights under the
Consumer Rights Act 2015 or other consumer-protection law, or excludes or limits our liability where
the law does not allow it.
If you are a business: to the fullest extent permitted by law we exclude all implied
conditions, warranties and representations relating to this website, and we will not be liable to you
for any loss or damage — whether in contract, tort (including negligence), breach of statutory duty or
otherwise — arising out of or in connection with your use of, or inability to use, this website, or
your reliance on any of its content. In particular, we will not be liable for any loss of profit,
loss of business, business interruption, or loss of business opportunity.
09Privacy
Your use of this website is also governed by our Privacy Policy and
Cookie Policy, which explain how we handle your personal data and use
cookies. Please review them.
10Changes to these terms
We may update these terms from time to time — for example to reflect changes in the law or in how the
site works. Any change applies only to your use of the site after we post it and does not apply
retrospectively. The "last updated" date at the top shows when we last changed them, so please check
it from time to time.
11Governing law and jurisdiction
These Terms of Use, their subject matter and their formation are governed by the law of
England and Wales. You and we agree that the courts of England and Wales have
exclusive jurisdiction, except that: (a) if you are a consumer, you keep the benefit of any mandatory
consumer-protection rules of the country where you live, and you may bring proceedings there; and
(b) nothing prevents us from enforcing our intellectual-property rights in the courts of any country.
12General
Severance — if any provision (or part of a provision) of these terms is held to be
unenforceable, the rest of them continue in force.
No waiver — if we delay in enforcing any of these terms, that is not a waiver of our
rights, and we may still enforce them later.
Third-party rights — except as expressly stated, no one other than you and us has any
right under the Contracts (Rights of Third Parties) Act 1999 to enforce these terms.
